1. Provider and scope
1.1RxApp is the web and mobile service of Dicabrio.com, Dijkwacht 114, 2353 EL Leiderdorp, the Netherlands; support@rxapp.io. These terms apply to your personal account, including when you also own or work for a gym. Separate gym terms apply to a gym's software subscription.
1.2Your membership is a contract with your gym, not RxApp. The gym determines prices, duration, bookings, cancellations and membership payments. Acceptance here does not accept the gym's membership terms or grant a direct debit mandate; those are separate arrangements.
2. Account and acceptance
2.1Provide accurate information, protect your credentials and report suspected misuse promptly. You are responsible for your own actions, not automatically for every third-party action or a security failure by RxApp.
2.2You accept through an initially unchecked box or a clearly labelled acceptance button. We record your account, document type, version, date and time and, where available, IP address. An app update alone does not require new acceptance.
2.3If you are a minor, involve your parent or guardian and obtain their permission where required by law. Acceptance of these terms does not replace any separately required permission for processing personal data. Gyms remain responsible for their admission rules.
3. Use and cost
3.1Current use of RxApp is free for athletes. RxApp may offer additional paid services in the future. Prices and any additional terms will be clearly stated in advance. A payment obligation arises only after you have expressly agreed to the paid offer. Gym functions depend on your gym and its RxApp subscription. Membership payments remain payments to the gym even when RxApp provides the technology.
3.2Your right to use RxApp is personal and non-transferable. Do not post unlawful content, harass others, infringe rights or disrupt the service. RxApp does not provide medical advice; consult a qualified healthcare professional for health questions.
4. Content and privacy
4.1You retain any rights you hold in your workouts, photos and messages. You grant RxApp only a non-exclusive, free licence to store, technically process and display that content as needed to operate the service and follow your settings, not an independent advertising licence. Personal data is governed by privacy rights, not ownership.
4.2This licence ends upon deletion except for limited legally necessary retention and backup handling. The privacy policy explains processing; acknowledging it is not blanket consent.
4.3You choose whether nobody, members of your gym or all RxApp athletes can find you in friend search. Until you choose, you are not discoverable, unless your gym has chosen findability within the gym; other members of that gym can then find you until you choose otherwise. A gym can never make you discoverable outside the gym. Search may show your name, photo and gym. Friendship requires both athletes' acceptance. Result visibility is a separate setting. Search visibility is separate from necessary staff access to gym administration and visibility in classes you attend.
5. Availability and responsibility
5.1We provide the service with care and work to resolve faults, but do not promise uninterrupted or error-free operation. We give advance notice of maintenance and significant changes where reasonably possible.
5.2The gym provides and is responsible for its classes, instructors, facilities and safety. This does not exclude RxApp's responsibility for its own failures. Mandatory consumer rights, including rights relating to defective digital services, remain unaffected. We do not exclude liability that cannot legally be excluded.
6. Deletion, restriction and ending use
6.1Delete your account in the app or request deletion via rxapp.io/account-deletion or support@rxapp.io. This does not cancel your gym membership or payment obligations; contact the gym to cancel.
6.2If your gym stops using RxApp, access to its functions and the administrative connection can change. Your personal account is not automatically deleted, nor is your actual membership automatically cancelled.
6.3For serious or repeated misuse we may remove content or restrict access proportionately, giving reasons and an opportunity to remedy where possible. Contact support@rxapp.io to challenge a decision. Urgent security risks or legal obligations may require immediate action.
7. Changes, complaints and law
7.1We notify you of material changes in advance in the app or by email and request explicit acceptance of new terms. If you decline, you may stop using the service and contact us for access, export or deletion. A privacy policy update alone is not a request for blanket consent.
7.2Contact support@rxapp.io with complaints. Dutch law applies without removing mandatory consumer protection in your country of residence. Disputes may be brought before the court competent under applicable law; there is no compulsory arbitration.
